Mr. Chief Inspector General,

The National Human Rights Defense Network (RNDDH), profoundly alarmed by the death of the accused Renèce Cheron, alias "l'homme," which occurred at the Central Directorate for the Judiciary Police (DCPJ) on July 11, 2008, sends this correspondence to you with the goal of obtaining the needed clarification regarding this affair.

On July 11, 2008, the aforementioned Renèce Cheron was arrested by the DCPJ in the case of the kidnapping of Carmelissa Meronvil, a 3 year old girl, which took place on June 29, 2008 at Delmas 83. RNDDH is surprised to learn that the name Renèce Cheron is not included in the DCPJ's current register and notes that Cheron, after being arrested, collaborated with police officers by denouncing numerous others involved in this case.

This collaboration allowed the DCPJ to proceed with the arrest of Antoine Jocelyn and to find others involved in the kidnapping of the child. Meanwhile, according to information received, Renèce Cheron died during the night on July 11, 2008 due to grave physical abuse. His body, removed without report, was transported to the Haitian State University Hospital (HUEH) on July 12, 2008 and was registered at the morgue of the hospital as number 251.

The Divisional Commissioner of the Central Directorate of the Judiciary Police (DCPJ), Mr. Frantz Thermilus, confirmed that Renèce Cheron was one of the principal suspects arrested by the police in the kidnapping case of Carmelissa Meronvil. He also affirmed having been informed by officers of the accused's failed state of health around 9 o'clock in the evening and ordered for his transfer to the hospital. It was not until July 12 that he learned of the death.

RNDDH deplores the kidnapping of Carmelissa and demands that police authorities make every effort to obtain the release of the young girl.

Furthermore, RNDDH firmly condemns the provoked death of the accused, Renèce Cheron, and believes that this was not a coincidence, given that the hostage is still in the hands of the kidnappers.

RNDDH notes that up till the present date, no effort has been made to clarify this situation and to provide the public with information relative to the death of Renèce Cheron.

Based on these facts, RNDDH instructs the PNH General Inspection to:


-  proceed with the autopsy of the body to determine the precise causes of the death of Renèce Cheron;


-  open an investigation into the possible involvement of the DCPJ officers in the death of Renèce Cheron;


-  publish the findings of the investigation; and


-  sanction all police officers involved in the death of Renèce Cheron.

In the hope that urgent follow-up will be given to this case, RNDDH asks that you, Mr. Chief Inspector General, receive its distinguished salutations.

RNDDH's Position Regarding the August 6, 2008 Incident in Cité Soleil

The National Human Rights Defense Network (RNDDH) learned with dismay about the incident that took place in Cité Soleil on August 6, 2008 during which two agents from the Haitian National Police force were beaten by soldiers from the Brazilian contingent of the United Nations Stabilization Mission in Haiti (MINUSTAH).

Early in the morning of August 6, 2008, soldiers from the Brazilian contingent, housed in the Cité Soleil police station housing, set up a fixed patrol near the public market situated across from the police station, not far from the public transportation station that makes its route from Cité Soleil to Downtown. A routine check was conducted of all persons who had bags in their possession.

After working the night of August 5, 2008, Donson Bien-Aimé and Onald Denis, A2 and A3 PNH agents respectively from the Cité Soleil station, were at the transportation station waiting for a truck in order to return home. The two officers, dressed in civilian clothing, had in their possession a bag and were stopped by the MINUSTAH agents who demanded to look inside the bag. Donson Bien-Aimé and Onald Denis opposed the demand and presented themselves as police officers, without presenting their badges. An altercation followed.

The two officers, after being brought under the control of the peacekeepers, were beaten by the peacekeepers despite the intervention by the commissioner from the Cité Soleil station, divisional inspector Rosemond Aristide. According to the reports, Onald Denis, following the blows he received, lost consciousness. Then, the two victims were taken to the Canapé Vert Hospital.

A photo-journalist in the crowd from Alerte-Haïti, Evens Saint Felix, was injured.

The August 6, 2008 incident clearly demonstrates a flagrant lack of collaboration between PNH officers and those from MINUSTAH in certain areas, particularly in Cité Soleil.

RNDDH notes that this incident was not the first of its kind to occur with agents from MINUSTAH.


-  On December 6, 2005, soldiers from the Jordanian contingent in Petite Place Cazeau opened fire on a police patrol, injuring two officers.


-  On May 29, 2008, police officer Lucknis Jacques, stationed at the Cité Soleil station, was beaten by MINUSTAH agents.

RNDDH continues to believe that peacekeepers who cannot speak French or Creole are unable to make themselves understood by the police officers and the population.

RNDDH deplores the behavior of the MINUSTAH agents and points out that this incident came at a moment when Cité Soleil is becoming, little by little, a normal area. Consequentially, RNDDH requests that:


-  An investigation be conducted to shed light on the August 6, 2008 incident;


-  Sanctions be taken against the MINUSTAH agents at fault;


-  An effective work method be established between the two entities, the PNH and MINUSTAH, in order to avoid repeating such acts.

RNDDH konstate genyen plizyè fòm seksyalite, men genyen yon ki dominan. Reyalite sa a pa bay okenn moun oubyen sektè dwa pou yo pa rekonèt lòt fòm seksyalite nan kondane yo paske yo pa bon oubyen yo pa moral.

RNDDH ap poze tèt li kesyon sou pale anpil ki chita sou zen kap fèt sou oryantasyon seksyèl pwemye minis deziye a, madam Michele Duvivier Pierre Louis, prezidan peyi chwazi pou vin n premye minis.

RNDDH ap mande pou ki sa pawol sa yo pat janm pale sou oryantasyon seksyèl anpil gwo reskonsab ki te nan leta kite gen gwo bri ki tap kouri sou yo.

Èske se paske se gason yo te ye ki lakoz pawol sa yo pat pale? RNDDH ap raple sosyete a, si nou vle konstwi yon demokrasi tout bon, fèk nou respekte tout dwa moun genyen. Tan kou :


-   Dwa sante, lojman, manje, pale, patisipe nan zafè peyi a, ak dwa oryantasyon seksyèl.


-   RNDDH kwè oryantasyon seksyèl yon moun pa genyen anyen poul wè ak konpetans, kapasite, moralite pou l okipe yon fonksyon nan leta. Se pito oryantasyon ak vizyon l, pou l fè respekte dwa moun ki enpòtan.


-   RNDDH ap sonje palmantè nou yo, yo pa la pou pase dwa moun anba pye ; men yo la pito pou yo mete kanpe bonjan estrikti pou pèmèt dwa moun respekte. Kidonk, palmantè nou yo pa genyen pou konsidere zen kap fèt sou oryantasyon seksyèl yon kandida pou primye minis, pou di li pa moral.

Statement by Executive Director Pierre Esperance, July 10, 2008

RNDDH, an organization that promotes and defends human rights, recognizes the liberty each person has to choose their sexual orientation or the sexuality they desire according to the corresponding principles of human rights. These principles primarily include the Universal Declaration of Human Rights and the International Pact for Civil and Political Rights.

RNDDH notes that there are numerous forms of sexuality, but one that is dominant. This reality does not grant any person or sector the right to deny other forms of sexuality by condemning them, claiming they are not good or moral.

RNDDH questions the debate surrounding the sexual orientation of the designated Prime Minister.

RNDDH asks why this debate has never before occurred regarding the sexual orientation of the many other dignitaries who have held high positions within the State, though there was talk surrounding them.

Is it because the others were men that this question was not raised? RNDDH reminds Haitian society that if we want to build a proper democracy, we must respect all rights of others. For example:


-   The right to health, a home, food, speech, and participation in the country's affairs along with the right to sexual orientation.


-   RNDDH believes that the sexual orientation of a person has no relation to the competency, capacity, or morality a person needs to hold a position with the State. It is, rather, the politics and vision of a person that lead him/her to respect human rights that is important.


-   RNDDH reminds Parliament that they are not in their positions to violate human rights, but rather to guarantee human rights. Thus, Parliament has no reason to consider the talk surrounding the sexual orientation of a candidate for the position of Prime Minister, has no reason to claim that he/she is immoral.


-  Therefore, RNDDH reminds Parliament that the State has an obligation to guarantee human rights without regard (an obligation without discrimination) to: color, sex, race, religion, or social status.

Others who have served as Prime Minister, Ministers who have been surrounded by rumors regarding their sexual orientation, have never had to tolerate this.


-  As such, Parliament has never posed questions regarding the rumors surrounding the sexual orientation of a candidate because she is female.


-  Questions of other forms of sexuality have existed throughout the country. Rumors have spread regarding many men, but there has never been a debate carried out about such matters.


-  Therefore, it seems clear that this is not a debate regarding sexual orientation, but rather this is a debate whose roots are in sex discrimination.


-  RNDDH believes that the Haitian society must end with this hypocrisy because hypocrisy will not help us to respect human rights; on the contrary, it will only encourage the violation of human rights.


Position du RNDDH par rapport aux mouvements de protestation contre la cherté de la vie

Déclaration de Pierre Espérance, 09/04/08

Le Réseau National de Défense des Droits Humains (RNDDH) prend note d'une vague de protestations contre la cherté de la vie, qui déferle sur le pays depuis le début du mois d'avril 2008.

Les revendications du peuple haïtien consistent en la réduction des prix des produits de première nécessité et en l'accès au droit à l'alimentation, un droit fondamental que tout gouvernement a le devoir de garantir.

Toutefois, le RNDDH déplore le fait que ces mouvements de protestation, aussi légitimes soient-ils, soient émaillés d'actes de violences, de vols et de pillages. Ces actes sont inacceptables au sein d'une société démocratique.

Le RNDDH désapprouve les attaques perpétrées contre Télé Haïti, le journal Le Matin, Radio Vision 2000, etc. et contre certains journalistes, victimes dans l'exercice de leurs fonctions. Le RNDDH attire l'attention de tous notamment des manifestants et des forces de l'ordre, qu'ils ont intérêt à protéger la liberté d'expression, symbolisée par la Presse et les journalistes.

Le RNDDH condamne le manque de professionnalisme enregistré du côté des forces de l'ordre dans la protection des droits et des biens des citoyens. Les forces de l'ordre se sont rendues responsables de mauvais agissements contre la population civile, occasionnant ainsi plusieurs cas de décès et de blessés par balles, particulièrement dans la ville des Cayes et des cas de blessés à Port-au-Prince devant le Palais National. En présentant ses sympathies à toutes les victimes de ces événements et à leurs familles, le RNDDH souhaite ardemment que les responsables de ces actes de pillage, de vols, de viols, de meurtres, et d'utilisation abusive de la force, soient arrêtés et déférés par devant la justice afin de répondre de leurs actes, quelque soit leur accointance et leur degré de responsabilité dans la société.

Le RNDDH attire l'attention du pouvoir exécutif et du Parlement haïtien sur le fait que ces mouvements de protestation résultent de l'application de la politique néolibérale par ce gouvernement. Aujourd'hui, Il y a donc nécessité pour le pouvoir de revoir son orientation économique, de cesser de se faire dicter sa conduite par le Fonds Monétaire International et la Banque Mondiale, mais d'appliquer une politique économique sociale prenant en compte les revendications et les intérêts de la population : la prise de mesures efficaces en vue de baisser le coût de la vie, la création de travaux à haute intensité de main d'œuvre, le renforcement et le soutien de la production nationale, la cessation des gabegies dans l'administration étatique, le combat contre la corruption et l'impunité au sein de l'Etat sont autant de solutions pouvant éviter la répétition de tels mouvements.

Statement by Pierre Esperance, 09/04/08

RNDDH acknowledges the large protest movement the Haitian people are conducting throughout the country to reclaim their right to eat and their right to access to the basic goods used every day. RNDDH considers this reclamation legitimate.

The right to eat is a fundamental right that any respectable government must guarantee for its citizens.

At the same time, RNDDH deplores that this protest movement is accompanied by numerous acts of violence, of theft, of pillage. These violent acts are not acceptable in a democratic society.

RNDDH condemns the attacks against the press, such as TeleHaiti and the newspaper Le Matin, along with the journalists who were victim while carrying out their work. RNDDH reminds those demonstrating along with those responsible for maintaining order that they must protect the freedom of speech that the press and journalists represent.

RNDDH condemns any lack of professionalism by those responsible for maintaining order, whether through a lack of protecting the rights and well-being of citizens or through improperly acting against the civil population, injuring many with bullets most notably in the town of Aux Cayes and in front of the National Palace in Port-au-Prince.

RNDDH deplores the fact that many demonstrators, principally those in Aux Cayes, lost their lives through conditions that are not clear.

RNDDH extends its condolences to all those who were victim during these events.

RNDDH hopes that those who participate in pillaging, theft, destruction, those who use guns without thought, and those who abuse their force will answer to justice for the acts they committed, no matter what their rank in society or institution they are a part of.

RNDDH asks the president of the Republic along with the government and Haitian parliament to consider that it is the application of Neoliberal policies that is the cause of this protest movement.

Today, those in power must do whatever is necessary to change the economic orientation, to stop taking orders from the IMF and the World Bank. Institute a social economic policy that takes into account the claims of the mass population.

Create jobs. Take effective measure to lower the cost of living. Stop the waste in the state administration. Fight corruption and impunity in the state.
